ĀTEA VENDOR TERMS AND CONDITIONS
For Entry and Trading at Ātea Events

The following Terms and Conditions apply to entry and trading as a Vendor at events organised or hosted by TĀme Iti Ltd and Te Ahi tahutahu Charitable Trust at Ātea, 266 The Strand, Whakatāne (collectively, the "Organiser").

By accepting these Terms and Conditions through our online registration process, you and your employees warrant and represent that you agree with these Terms and Conditions.

Failure to comply with these conditions may result in immediate removal from the Event, penalties, and exclusion from future events.

1. CONDITIONS OF ENTRY AND TRADING

1.1 Vendors must accept these Terms and Conditions before a booking can be confirmed.

1.2 The Vendor and all employees working at the event must be 18 years or older.

1.3 The Organiser reserves the right to refuse entry to any person for any lawful reason at its sole discretion.

1.4 Vendor selection is at the Organiser's discretion. Being in the vendor pool does not guarantee a trading spot at any specific event. The Organiser may rotate vendors between events to maintain variety.

1.5 This Agreement is governed by the laws of New Zealand.

2. FOOD AND BEVERAGE VENDORS — ADDITIONAL REQUIREMENTS

The following requirements apply to Food and Beverage Vendors only:

2.1 Food Vendors must hold a current Food Registration Certificate and attach a copy when submitting their application. The certificate must be displayed at all times while trading.

2.2 Food Vendors must have a 2.5kg dry powder fire extinguisher and fire blanket on site at all times.

2.3 All gas equipment must have current safety certification.

2.4 Food Vendors must comply with all food safety standards, including proper food handling, preparation, handwashing, and storage practices. Vendors must have appropriate equipment to chill food at 5°C and under.

2.5 The Organiser and Whakatāne District Council reserve the right to inspect food vendor sites at any time.

3. EVENT MANAGEMENT

3.1 Events may take place outdoors and may be subject to adverse weather. Vendors should bring suitable equipment and protection.

3.2 The Organiser may cancel or modify events at its sole discretion, including due to weather or safety concerns.

3.3 Vehicles may not be parked on-site unless prior arrangement has been made with the Organiser. Bump-in and bump-out times will be communicated for each event.

4. PROHIBITED ITEMS AND CONDUCT

4.1 Vendors shall not trade in:

  • Products of an offensive nature

  • Alcohol or illegal drugs

  • Dangerous items

4.2 Vendors found with prohibited items may be removed from the event.

5. POWER, WATER, AND WASTE

5.1 Vendors are responsible for providing their own power supply (generators, batteries, etc.) and ensuring all electrical equipment is safe and compliant with New Zealand standards.

5.2 Food Vendors are responsible for their own supply of potable fresh water.

5.3 Vendors are responsible for removing all their waste, including grey water, cooking oil, and commercial rubbish. Waste must not be discharged onto the ground or into drains.

5.4 Vendor sites must be left clean and in the same condition as found.

6. SIGNAGE

6.1 Food Vendors must display their Food Registration Certificate at all times.

6.2 All Vendors must have clear signage showing their products and prices 

7. INSURANCE AND LIABILITY

7.1 Entry and trading is at the Vendor's own risk. To the extent permitted by law, the Vendor waives all claims against the Organiser for loss, damage, injury, or death arising from attendance at the Event.

7.2 Vendors must hold valid public liability insurance covering personal injury, death, and property damage arising from the vendor's activities.

7.3 Vendors are responsible for insuring their own stock, equipment, and perishable goods, including against event cancellation.

7.4 The Organiser is not liable for any loss or damage to vendor property or stock, regardless of cause.

8. HEALTH AND SAFETY

8.1 Vendors must comply with the Health and Safety at Work Act 2015 and all applicable regulations.

8.2 Vendors must ensure their trading area is safe, properly maintained, and free from hazards.

8.3 All employees must have adequate health and safety training for their roles.

8.4 Accidents, injuries, or incidents must be reported immediately to the Organiser.

9. CODE OF CONDUCT

9.1 The following behaviour is strictly prohibited:

  • Violence, threats, or aggressive behaviour

  • Discriminatory language or conduct (including racist, sexist, homophobic, or ableist behaviour)

  • Harassment, intimidation, or unwelcome physical contact

  • Consumption of alcohol or drugs while trading

  • Any criminal or illegal activity

10. REFUNDS AND CANCELLATION

10.1 Vendors who withdraw within 5 days of an event are not entitled to any refund of fees paid.

10.2 Vendors removed for breach of these Terms and Conditions are not entitled to any refund.

10.3 In the event of cancellation due to any circumstances the Organiser will refund fees.

11. ACCEPTANCE

By selecting "I accept" on the vendor registration form, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions on behalf of yourself and your employees.

Electronic acceptance constitutes a binding agreement equivalent to a written signature.
